Abstract:
Our daily lives are increasingly permeated by connected devices. Networking not only opens up new possibilities of use. It also makes users dependent on the will of the provider when using the devices. The provider can lock the device by blocking integrated software or denying access to the cloud. This turns a high-tech device into electronic waste. Contract law often applies in such cases. But what if there is no contract between the user and the provider? In this case, users are dependent on the protection of property rights. The question is to what extent digital, i.e. software or network-based use is subject to such protection at all.
